87 year old Federal judge David Hittner just struck down Texas SB 12, blocking restrictions on sexually oriented performances in front of minors. His closing line to anyone who objects: “just don’t go.” That’s not a serious answer. The law targeted commercial venues hosting sexualized acts around children, not private adult events. Telling parents to simply stay home ignores the state’s interest in keeping explicit content away from kids in public and commercial spaces. Overbreadth arguments shouldn’t swallow the ability to draw a line at minors.
